Terms of service

The short version
  • Early Bird sells research and launch plans. It does not sell an outcome, and it does not promise you will earn anything.
  • Revenue figures are labelled Potential because they are estimates of what an opportunity could earn. They are not a forecast of your results.
  • Essential is free. Insider is a subscription that renews until you cancel, and you can cancel in two clicks. There is a 14 day full refund on your first payment.
  • Use the content for your own business as much as you like. Do not copy it, share it, scrape it, resell it, or use it to train a model.
  • Your rights under the Australian Consumer Law are not affected by anything on this page.

1. Who we are and what these terms cover

Early Bird is operated by The Early Bird Co, referred to in these terms as Early Bird, we, us and our. These terms apply to the website at theearlybird.co, the application at app.theearlybird.co, and every email, notification and piece of content we provide through them (together, the Service).

By browsing the Service, creating an account, or paying for a subscription, you agree to these terms, to our Privacy policy and to our Refund policy, which form part of this agreement. If you do not agree, do not use the Service.

2. Eligibility and your account

  • You must be at least 18 years old to create an account or buy a subscription.
  • You must give us accurate information and keep it up to date.
  • You are responsible for keeping your login details private and for everything done under your account. Tell us straight away at info@theearlybird.co if you think someone else has used it.
  • Accounts are for one person. Sharing an account, or sharing Insider content with someone who has not paid for it, is a breach of these terms.
  • If you are using the Service on behalf of a business, you confirm you have authority to bind that business, and "you" includes it.

3. What Early Bird is

Early Bird is a research and educational product. We publish a curated board of business opportunities (gaps). Each gap describes a business model applied to a particular industry, the tools we believe it needs, our estimate of what it could earn, and a five stage launch plan made up of tasks and prompts. Some gaps are open to everyone. Others are open only to Insider subscribers. What you are buying is access to that research and those instructions.

4. No promise of income

Nothing on the Service is a promise, guarantee or prediction that you will earn money. Every revenue figure we show is labelled Potential. It is our estimate of what a business of that kind could earn, based on public information about what comparable operators charge and sell. It is not a statement of what any real business has earned, and it is not a forecast of what you will earn.

What you earn, if anything, depends on your effort, skill, timing, market, pricing, costs, competition, and on factors nobody controls. Many people who start a plan will earn nothing. Some will lose money on tools, advertising or stock. You accept that risk when you decide to act on anything you read here.

We do not publish testimonials that show earnings, and we do not want you to rely on any earnings claim you see anywhere else about Early Bird. If you see one, tell us.

5. Not professional advice

We are not financial advisers, accountants, lawyers, tax agents or licensed professionals of any kind. Nothing on the Service is financial product advice, investment advice, legal advice, tax advice or medical advice. Some of the gaps describe businesses in regulated industries (for example health, finance, food, education and services to children). It is your responsibility to find out what licences, registrations, insurance, consumer protection and other laws apply to you, in your location, before you act, and to get proper advice from a qualified person.

6. Plans, prices and renewals

Essential is free. It includes the whole board, your match score on every gap, and at least one full sample launch plan. We may change what Essential includes.

Insider is a paid subscription that opens every launch plan on the board. The current prices are shown on the pricing page and again at checkout. Prices are in the currency shown at checkout. Where a tax such as GST or VAT applies, it is either included in the price shown or added at checkout, and the checkout page will make that clear before you pay.

  • Automatic renewal. Insider renews automatically at the end of each billing period (monthly or yearly, whichever you chose) and your payment method is charged at the then current price, until you cancel.
  • Cancelling. You can cancel at any time from your account. Your subscription then runs to the end of the period you have already paid for and is not renewed. Cancelling does not refund the current period, except as set out in the Refund policy.
  • Price changes. We may change the price of Insider. We will email you at least 30 days before a change takes effect, and it will only apply from your next renewal after that date. If you do not want to pay the new price, cancel before it renews.
  • Failed payments. If a renewal payment fails we may retry it and email you. If it still fails, Insider access ends and your account returns to Essential. You do not lose your account, saves or progress.
  • Promotions. Discounts and offers have their own conditions, which we will state when we make the offer. Unless we say otherwise they are one per customer and cannot be combined.

7. Payments

Payments are processed by Stripe. Your card details go to Stripe and are never stored by us. By paying, you confirm you are authorised to use the payment method. Stripe's own terms and privacy policy apply to how it handles your details. If you dispute a charge with your bank instead of contacting us first, we may suspend your account while the dispute is resolved. We would much rather you emailed us: most refund questions are sorted within a day.

8. Your licence to use the content

The gaps, launch plans, tasks, prompts, revenue estimates, tool lists, text, design, code, the Early Bird name and the pixel bird are owned by us or licensed to us, and are protected by copyright, trade mark and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to view and use the content for the purpose of starting and running your own business. Within that purpose you may use any plan or prompt as many times as you like, adapt it as you like, and keep using anything you have already used after your subscription ends.

You may not:

  • copy, publish, share, forward, screenshot for distribution, or otherwise reproduce any gap, plan or prompt for anyone who is not the account holder;
  • sell, license, rent or otherwise commercialise the content itself, including inside a course, newsletter, community, template pack, report or paid group;
  • scrape, crawl, download in bulk or use any automated means to extract content from the Service, or access the Service through anything other than the interfaces we provide;
  • use the content, in whole or in part, to train, fine tune, prompt, evaluate or build any machine learning model, dataset or AI product;
  • build, or help someone else build, a product that competes with Early Bird using our content or our structure;
  • remove or alter any notice of ownership, or present the content as your own work;
  • attempt to bypass any paywall, redaction, lock, rate limit or other control that restricts access to Insider content, or help anyone else to do so.

This licence ends if you breach these terms. Any use of the content outside this licence without our written permission is an infringement of our rights and we may act on it.

9. Prompts, AI tools and third party services

Many of our plans ask you to run prompts in AI tools such as Claude or ChatGPT, and to use third party services such as payment processors, website builders, advertising platforms and marketplaces. Those tools and services are not ours. We do not control them, we are not affiliated with or endorsed by them unless we say so, and their names and logos belong to their owners. Your use of them is governed by their own terms, prices and policies, which may change without notice.

AI tools can produce output that is wrong, out of date, biased, or unsuitable for your situation. You are responsible for checking anything an AI tool produces before you rely on it or publish it, and for making sure what you publish is accurate, lawful and does not infringe anyone's rights.

10. Acceptable use

When using the Service you must not:

  • break any law, or use the Service to plan or run a business that is unlawful, deceptive or harmful;
  • interfere with the Service, probe or test its security, or introduce malicious code;
  • impersonate anyone, misrepresent your connection with anyone, or misrepresent Early Bird;
  • use the Service to send spam or unsolicited commercial messages;
  • make earnings claims about Early Bird, or about any gap, that we have not made ourselves.

11. What you give us

You own your quiz answers, saves, notes and progress. You give us a licence to store and process them so the Service works for you, as described in our Privacy policy. If you send us feedback, suggestions or ideas, you agree we may use them without any obligation to you, and without payment or credit.

12. Availability and changes

We work to keep the Service available, but we do not guarantee that it will be uninterrupted, error free or available at any particular time. We may add, change or remove features, add or remove gaps from the board, change how gaps are scored or grouped, and change the number of gaps that are free or paid. We publish new gaps on a schedule we set, and we may change or pause that schedule. None of this entitles you to a refund except where the Refund policy or the law says so.

13. Suspension and ending the agreement

  • You can close your account at any time from your account settings or by emailing info@theearlybird.co. Closing your account cancels any subscription. Your paid period is not refunded unless the Refund policy says otherwise.
  • We may suspend or close your account, with or without notice, if you breach these terms, if we reasonably believe your use is harmful to the Service or to other users, if a payment is disputed or reversed, or if we are required to by law.
  • If we close your account for a reason that is not your fault, we will refund the unused part of any subscription you have paid for.
  • If we decide to stop offering Insider or the Service altogether, we will give you at least 30 days notice by email and refund the unused part of any subscription.
  • Sections 4, 5, 8, 9, 14, 15, 16 and 18 continue to apply after the agreement ends.

14. Consumer guarantees

If you are a consumer under the Australian Consumer Law, or under similar laws where you live, you have guarantees that cannot be excluded, restricted or modified by contract. Among other things, our services must be provided with due care and skill, be fit for any purpose you told us about, and be delivered within a reasonable time. Nothing in these terms excludes, restricts or modifies those guarantees or any liability we cannot lawfully limit.

Where the law lets us limit our liability for a breach of a guarantee relating to services, we limit it to supplying the services again or paying the cost of having them supplied again, whichever we choose. A failure to make money from a gap is not a failure of our service, for the reasons in section 4.

15. Disclaimers

Subject to section 14, the Service and all content are provided "as is" and "as available". We do not warrant that any gap is accurate, complete, current, achievable, lawful in your location, or suitable for you. Research goes stale, markets move, tools change their pricing and terms, and some opportunities close. We do our research by hand and with care, but it is research, not a due diligence report on your circumstances.

16. Limitation of liability

Subject to section 14, and to the fullest extent permitted by law:

  • we are not liable for any loss of profit, revenue, business, opportunity, goodwill or data, or for any indirect, consequential, special or exemplary loss, however it arises, including from any decision you make in reliance on the Service;
  • we are not liable for any loss caused by a third party tool, service, platform, supplier or AI output that a plan refers to;
  • our total liability to you for all claims arising out of or connected with the Service or these terms is limited to the greater of the amount you paid us in the 12 months before the claim arose and AUD 50.

17. Your responsibility to us

You agree to compensate us for any loss, liability or cost (including reasonable legal costs) that we suffer because of a claim by a third party arising from your breach of these terms, your breach of the law, or your use of the content in a business you run. This does not apply to the extent the loss was caused by our own breach or negligence.

18. Governing law and disputes

These terms are governed by the laws of New South Wales, Australia. If you have a problem, email info@theearlybird.co first and give us 30 days to sort it out. Most problems are sorted in one reply. If we cannot resolve it, the courts of New South Wales and the courts able to hear appeals from them have jurisdiction, without limiting any right you have under consumer law to bring a claim where you live.

19. Changes to these terms

We may update these terms. For a minor change (such as wording or a new feature) we will update the date at the top. For a change that reduces your rights or increases your obligations, we will email account holders at least 14 days before it takes effect. If you keep using the Service after that date you accept the new terms. If you do not accept them, cancel and close your account before that date and you will not be bound by the change.

20. General

  • These terms, the Privacy policy and the Refund policy are the whole agreement between us about the Service and replace any earlier agreement.
  • If any part of these terms cannot be enforced, that part is removed or read down as far as needed and the rest continues to apply.
  • If we do not act on a breach straight away, we can still act on it later.
  • You may not transfer your account or this agreement to anyone else. We may transfer it to a successor business that takes over the Service, and we will tell you if we do.
  • Neither of us is liable for a delay or failure caused by something outside our reasonable control.
  • Notices to you are sent to the email address on your account. Notices to us go to the address below.
